Terms and Conditions of the University Library of Johannes Gutenberg University Mainz

Based on section 76 subsection 2 no. 5 of the University Act (Hochschulgesetz, HochSchG) of Rhineland-Palatinate dated September 23, 2020 (GVBl. p. 461), last amended on November 26, 2024 (GVBl. p. 373, 377), and in conjunction with section 12 subsection 2 of the Charter of Johannes Gutenberg University Mainz dated December 15, 2022, the Management of the University Library of Johannes Gutenberg University Mainz issued the following Terms and Conditions on February 10, 2025. The University Senate was informed on February 7, 2025.

I General information

Section 1 Scope

These Terms and Conditions apply to the University Library of Johannes Gutenberg University Mainz (University Library) and all associated organizational units.

Section 2 Acknowledgement of the Terms and Conditions

By entering the premises of the University Library or using its services, users acknowledge and accept the validity of the Terms and Conditions.

Section 3 Duties of the University Library

The University Library serves to supply Johannes Gutenberg University Mainz (JGU) with information for research, teaching, studies, and continuing education. The University Library provides the necessary items, bibliographic information, and information infrastructure, functions as a place of work, of learning, and of communication, and performs tasks in the context of the regional and national information supply network. The University Library supports JGU in fulfilling its responsibilities by producing digital copies and audiovisual media. The University Archives, which are part of the University Library, preserve JGU’s records in accordance with the archival law of Rhineland-Palatinate.

Section 4 Authorization for use

  1. The University Library’s user-accessible areas can be accessed without formal permission.
  2. Every member of JGU has the right to use the University Library. Beyond that, the University Library may be used by others who are not members of JGU as long as this does not jeopardize the University Library’s primary responsibility to provide service to JGU in accordance with section 3. Persons who are not members of JGU may only use the services of the Center for Audiovisual Production within the framework of cooperation agreements. In order to use University Archives and the Mainz Publishing Archive, an application for use must be submitted.
  3. (When users register at the University Library, they are issued a library card number, which is displayed as a machine-readable code on a suitable device. The image serves as a library card. Members of JGU are automatically registered for use of the University Library when they become members of JGU. The library card is used to borrow items. It is non-transferable. The regulations of the Studierendenwerk Mainz apply for the use of older library cards issued in the form of cards from the Studierendenwerk.
  4. Registration for use of the University Library requires the provision of the following documents:
    1. Employees of the University Medical Center of Johannes Gutenberg University Mainz: proof of employment at the University Medical Center (employment contract) and official photo ID (identity card or passport with registration certificate issued by German government officials).
    2. Persons who are not members of JGU: official photo ID (identity card, or passport with registration certificate issued by German government officials).
  5. Minors who are not members of JGU require written consent from their legal guardian to register for University Library services. By granting their consent, the legal guardian accepts responsibility for any liability claims arising from the user relationship.
  6. When registering, personal data are collected and stored in compliance with data protection regulations insofar and as long as the University Library requires them to fulfill its tasks. As far as possible, the personal data required for managing the lending of items are electronically transmitted from JGU’s central identity management system to the University Library. Users can view the stored personal data related to them upon request.

Section 5 Change of address, contact details, exmatriculation

  1. Employees of the University Medical Center and persons who are not members of JGU must inform the University Library of changes to their contact information without delay. In the event of a breach of the aforementioned obligation, the person concerned is liable to the University Library for any resulting costs and disadvantages.
  2. Students must return all borrowed items and pay any outstanding fees and expenses at the time of exmatriculation. The same applies to employees upon leaving JGU.
  3. If the requirements for holding a library card are no longer met, users must return all borrowed items and pay any outstanding fees and expenses.

Section 6 Opening hours

  1. The opening hours for the individual locations of the University Library are determined by the management of the University Library in agreement with the relevant faculties and made public by means of posting notices and publishing the information on the University Library website.
  2. The University Library may allow access to its libraries even when library staff is not present by controlling access electronically. The libraries in question are only accessible for JGU members at these times.

Section 7 Fees

  1. In general, use of the University Library is free of charge unless otherwise stipulated by the State Directive on the Collection of Fees in the Fields of Science, Education, and Research (Special Schedule of Fees) (Landesverordnung über die Gebühren in den Bereichen Wissenschaft, Weiterbildung und Forschung (Besonderes Gebührenverzeichnis)) in its respective current version. Use of the University Archives is generally free of charge.
  2. A card usage fee may be incurred for the issue of a physical library card.
  3. Persons who are not members of JGU must pay an annual fee for use of the University Library. The fee is based on the Special Schedule of Fees. The fee is charged in addition to the card usage fee specified in subsection 2. This stipulation does not apply to those named in section 8 subsection 1 of the State Directive on the Collection of Fees.
  4. A fee may be charged for the use of lockers and carrels.
  5. A fee is charged for every request placed through the German interlibrary loan system (interlibrary loan), independently of whether or not the order is successfully filled. The fee is based on the Special Schedule of Fees. Additional fees charged by the lending library must be paid by the borrower. The costs incurred by the University Library as a result of international interlibrary loan requests are charged to the person who placed the request, in addition to a processing charge determined by the Special Schedule of Fees.
  6. The Service Center for Digitization and Photo Documentation offers fee-based services for members of JGU. The prices can be found in the current price list posted on the University Library website.
  7. The Center for Audiovisual Production offers fee-based services for members of JGU. Prices are calculated on a case-by-case basis and agreed on with the user.

Section 8 User Liability

  1. Users are liable for items they use in the reading room and for anything they borrow with their library card. In the event of lost or damaged items, the University Library will replace the item or arrange for the damage to be repaired. The person responsible must bear the costs. In addition, processing charges are incurred in accordance with the Special Schedule of Fees. Lost or damaged items must be reported to the University Library without delay. Once a replacement has been purchased, the resulting costs will not be reimbursed even if the items are returned at a later date.
  2. Users are responsible for checking the condition of items they intend to borrow and reporting any existing damage immediately. If users do not report any damage, the items are assumed to be in undamaged condition at the time they were borrowed.
  3. The loss of a library card must be reported to the University Library without delay. The library account will be blocked until a new library card is issued. The issuance of a new library card is subject to charge. The fee is based on the Special Schedule of Fees. The user is liable for any damage incurred up to the time the notice of loss is received by the University Library.
  4. The loss of transponders the University Library lends to individual users must be reported without delay. The user is liable for any damage incurred up to the time the notice of loss is received by the University Library. The user must bear the costs for the procurement of a new transponder.
  5. Users are responsible for checking the condition and completeness of any technical equipment and data carrier they intend to borrow in accordance with section 21 subsections 1 and 2, and for reporting any existing damage or missing parts without delay. If users do not report any damage, the equipment and data carriers are assumed to be complete and in undamaged condition at the time they were borrowed. Users are liable for the loss of and damage to borrowed technical equipment and data carriers.

Section 9 Disclaimer

  1. The University Library is not liable for the loss of or damage to items brought into the library.
  2. The University Library is not liable for damages resulting from incorrect, incomplete, or delayed services, or services that did not take place.
  3. The University Library is not liable for defective hardware or software, defective software installations, the backup of personal data on technical equipment or data carriers borrowed according to section 21 subsections 1 and 2, or for damages to data carriers or devices brought into the library.

Section 10 Rules of conduct

  1. All users are obligated to observe the Terms and Conditions, to show consideration for other users, and to behave in a manner befitting an academic place of work.
  2. Taking photographs or recording video or audio on library premises requires prior permission from the University Library management. Photographs in the form of reproductions according to section 23 are an exception.
  3. Animals are not permitted. Exceptions are guide dogs for persons with visual impairments and service dogs for users with proven disabilities (ID card for the severely disabled).
  4. The University Library regulations for taking along jackets, coats, and bags as well as the consumption of food and drink are made public by means of posting notices and publishing the information on the University Library website.

Section 11 Domiciliary rights and the right to inspect

  1. Library staff or staff working on behalf of the University Library have the right to require any person using the University Library to show official photo ID for a given reason.
  2. Library staff or staff working on behalf of the University Library have the right to inspect the contents of backpacks, bags, and similar receptacles.
  3. The instructions of the library staff or staff working on behalf of the University Library must be followed.
  4. University Library management exercises domiciliary rights on the premises of the University Library.

Section 12 Suspension of borrowing or usage rights

  1. Users who do not return expired items after being expressly requested to do so are not permitted to borrow further items until the requisitioned items have been returned. The request may be sent electronically.
  2. If a user of the University Library has outstanding fees of over 40 EUR or if accrued fees are not paid within four weeks, the user is not permitted to borrow any items until the fees have been paid in full.
  3. If a University Library user seriously or repeatedly violates the Terms and Conditions or if the library can no longer reasonably be expected to continue the user relationship, the University Library management may, if the person in question is a member of JGU, temporarily suspend usage rights or, if the person in question is not a member of JGU, either temporarily or permanently bar them from using library services. A temporary suspension of usage rights may not exceed a duration of six months.

II Use of items within the University Library

Section 13 Non-lending holdings

  1. In general, the following may only be used in the rooms of the University Library:
    1. special collections according to section 15 subsection 1,
    2. items of particular value,
    3. items published before 1919,
    4. reference works,
    5. freely accessible journal holdings,
    6. loose leaf editions,
    7. microforms,
    8. maps,
    9. items with numerous inserts, and
    10. items with an vulnerable preservation status.
  2. The University Library has the right to exclude further collections from circulation or to restrict their borrowing.
  3. The University Library determines exceptions from on-site use upon request.

Section 14 Using the reading rooms

  1. Users may not reserve workstations for their own use or for others without permission from the University Library.
  2. The University Library may assign special workstations or work areas for those working with special collections or in a particular manner.
  3. Users must vacate their workstation when they leave the library.
  4. Different locations of the University Library may regulate the occupancy of workstations in deviation from section 14 subsection 1 through the use of break discs, which are available for use in the relevant libraries. By setting the time on a break disc, users can reserve their workstation for up to 30 minutes, between 11:30 am and 1:30 pm for up to 60 minutes, if they are absent. Workstations without a break disc or with a break disc where the time has run out may be occupied by others. If break discs are in use, this is made public by means of posted notices and/or information published on the University Library website.

Section 15 Using special collections

  1. Manuscripts, autographs, old editions published before 1850, other special collections, and the holdings of the University Archives may generally only be used in specially designated reading areas.
  2. The use of these materials may be made subject to special conditions or prohibited for preservation reasons. If a digital copy is available, the original is only accessible in exceptional cases.
  3. When using the collections defined in section 15 subsection 1, jackets, coats, and bags are prohibited, as is the use of ink, ballpoint pens, and copying pencils. Eating and drinking is also not permitted.
  4. The use of items not suitable for unrestricted use due to legal regulations may be made dependent upon the substantiation of an academic or other legally recognized purpose and on special conditions.
  5. Use of the University Archives is subject to the provisions of Rhineland-Palatinate archival law in its respective current version.
  6. The use of archival material from the Mainz Publishing Archive may be dependent on consultation with the rightsholder.

Section 16 Course reserve

  1. To provide support for courses, items can be put on course reserve shelves for the duration of a semester and be subject to special conditions of use.
  2. The University Library makes its digital material available for use in online teaching and learning environments insofar as it is permitted to do so according to copyright law and contractual provisions.
  3. Lecturers must apply to set up a course reserve before the start of the semester.

Section 17 Lockers and carrels

  1. The University Library provides its users with day use lockers, long-term lockers, and carrels within the limits of its capacity. Unless otherwise specified below, the provisions which apply to the borrowing of items apply accordingly.
  2. The transponders needed to use the day use lockers can be purchased from the University Library. The loan period for day use lockers ends once the respective library location closes for the day. The day use lockers must be cleared out by closing time. Day use lockers that are occupied longer than one day will be opened and cleared out by library staff.
  3. The University Library provides doctoral candidates with long-term lockers and carrels. The transponders needed for the use of these are lent out. The loan period ends with the semester in question. If the loan period is exceeded, the lockers and carrels will be opened and cleared out.
  4. Potentially disruptive or dangerous items may not be stored in lockers or carrels.
  5. The University Library is authorized to check lockers and carrels if there is reasonable suspicion of misuse.
  6. The items found when clearing out a locker or carrel are treated as lost property. Items belonging to other libraries will be sent back. Items borrowed from the University Library will be returned.
  7. The user is charged 5 € or, if greater effort is required, 20 € if the University Library must open their locker or carrel. 

III Use of items outside of the University Library

Section 18 General lending conditions

  1. Items in the University Library may be borrowed for use outside the University Library provided they are not subject to lending restrictions according to section 13 subsection 1 or 2 or section 18 subsection 2.
  2. In the Law and Economics library, the items belonging to the fields of law and economics are primarily non-lending holdings. Items without a lending restriction according to section 13 subsection 1 or 2 may be borrowed by university employees and doctoral candidates under the conditions listed in section 19 subsection 4. Items without a lending restriction according to section 13 subsection 1 or 2 may be borrowed by students with proven restrictions (ID card for the severely disabled) or by students who bear the parental responsibility for children who are younger than seven years old (birth certificate of the child, photo ID of the student) for up to eight days.

Section 19 Borrowing items

  1. Persons in possession of a valid library card may borrow items available for loan. Users can place a hold on items that are currently checked out. If a user places a hold on items they intend to borrow, they will be notified as soon as they are available. Users have seven days on which the library is open to check out reserved media.
  2. The standard loan period is four weeks.
  3. Users can extend their loan period for four weeks five times upon request. The loan period cannot be extended if the item has been placed on hold.
  4. For university employees and doctoral candidates, the loan period ends with the current semester. Items borrowed within four weeks of the end of the current semester are due at the end of the following semester. Upon request, the loan period for borrowed items can be extended to the end of the upcoming semester five times. The loan period cannot be extended if the item has been placed on hold.
  5. Items whose loan period has been extended must be returned before the end of the loan period at the express request of the University Library. The University Library has the right to demand the return of items before the end of a loan period if there is an urgent need of them for research and teaching purposes or they are required for official reasons.
  6. If the loan period is exceeded, a late fee will be charged without sending out a final notice. The fee is based on the Special Schedule of Fees. Fees are collected in accordance with the Code of Administrative Court Procedure of Rhineland-Palatinate (Landesverwaltungsvollstreckungsgesetz) in its respective current version.
  7. Upon return of the borrowed item or the fulfillment of obligations to the University Library, the user will receive an electronic receipt. The electronic receipt must be presented if claims are made.
  8. Borrowed media may not be passed on to third parties.
  9. The University Library has the right to limit the number of items that can be borrowed by a single user at any given time.

Section 20 Interlibrary loans

  1. Items required for academic purposes that are not available in the University Library or in other publicly accessible libraries in Mainz (or, in the case of the Departmental Library for Translation, Linguistics and Cultural Studies, in Germersheim) may be ordered from external libraries in accordance with the provisions of the interlibrary loan regulations for German libraries (Leihverkehrsordnung) in its respective current version or the regulations for international interlibrary loans.
  2. The personal data required for ordering an item via interlibrary loan are processed, stored, and erased in compliance with data protection regulations. Users can view the stored personal data related to them upon request.
  3. Copies delivered via interlibrary loan are stored for six months from the date of delivery and can be picked up during this time. If the copies are not collected during this period, they will be destroyed.
  4. The special conditions of the lending libraries apply to the use of items procured via interlibrary loan; otherwise, the provisions of these Terms and Conditions apply.

Section 21 Borrowing technical equipment and teaching materials

  1. The University Library may lend out specially modified tablets to students of selected subjects for academic and study-related purposes for 16 weeks on an as-needed basis. The tablets are lent out with default settings. Further configurations can be made. Pre-installed apps may not be modified. The borrower is entitled to install and use further apps on the device using their own personal account and will bear any fees incurred for installation or use. The borrower may not make changes to the operating system, pass the tablet on to others, or grant rights to third parties.
  2. The Center for Audiovisual Production provides equipment and data carriers for the production of audiovisual media as part of workshops and courses. The period of use is based on the length of time the equipment is needed for the project. Malfunctions and issues affecting the equipment may only be resolved by University Library staff. Any data present on the data carriers upon return will be erased without consulting the user.
  3. The University Library lends out medical teaching material on a day-to-day basis.
  4. The regulations for borrowing items apply to technical equipment and teaching material borrowed under the conditions in section 21 subsections 1 through 3 accordingly.

IV Other use of the University Library

Section 22 Providing information

The University Library provides information in written and oral form as part of its duties. The information provided is recommendatory in nature.

Section 23 Reproductions

  1. Every user can make reproductions on their own within the University Library. Users are responsible for complying with copyright and personal rights regulations and other legal provisions.
  2. The University Library may exclude individual items and certain parts of its holdings from reproduction for preservation reasons.
  3. Recordings and photographs of the special collections named in section 15 subsection 1 are prohibited. The University Library can create digital copies upon request. Archival material in the University Archives may only be photographed with permission.

Section 24 Computer workstations and network access

The computer workstations and network access options provided by the University Library are available exclusively for research and teaching purposes.

Section 25 Digital material

  1. Users must observe licensing conditions and copyright when using digital material licensed by the University Library.
  2. Copyrighted digital material may not be used as the basis for self-learning AI applications. The University Library provides information on the relevant licensing conditions upon request.

V Final provision

Section 26 Entry into force

These Terms and Conditions enter into force upon publication in the JGU gazette of publications (Veröffentlichungsblatt) and replace the previous Terms and Conditions of the University Library, dated June 14, 2019. Additionally, the Terms and Conditions are published on the University Library website and made public by means of posting notices in the organizational units of the University Library.
